GADSDEN AL - 2011 - A LOOSE DOG BEGAN ATTACKING A CHILD WALKING IN A SCHOOL ZONE - AN OFFICER GOT THE DOG OFF THE CHILD AND SHOT IT WHEN IT LUNGED AT HIM

Tuesday, May 17, 2011 - Two children were walking in a school zone in East Gadsden when a dog began attacking one of the children. An officer was patrolling nearby and heard the children screaming.  The officer saw that one of the children was being attacked by the dog and he got  the dog off the child and placed himself between the dog and the children.  He then told the children to run to a nearby crossing guard.  The dog then lunged at the officer.  Another dog was with the attacking dog but he did not harm the children or officer.  He used his baton to fight off the dog and called for animal control.  When the dog continued to attack the officer,  He called for backup and had to shoot the dog.  The dog later died.  The child was injured and was treated by fire department medics, then taken to a hospital for treatment.

ENGLAND - THOUSANDS OF LONDONERS CALL ON #10 DOWNING ST. ASKING FOR TOUGH LAWS ON CRIMINALS USING DANGEROUS DOGS AS WEAPONS

Attack dogJack Wellstead
       JACK WELLSTEAD

May 31, 2011 -  LONDON EVENING STANDARD
Thousands of Londoners today called for tough action to crack down on criminals using dangerous dogs as weapons.

A petition of nearly 4,500 names was presented to Downing Street urging stricter sentences for thugs owning so-called "weapon dogs" such as pitbull terriers.

The move is part of a campaign by Kit Malthouse, the Deputy Mayor for Policing, to lobby the Government to bring in tougher legislation on banned dogs. Figures show that a Met police unit which targets dangerous breeds seized 1,072 dogs last year, of which 80 per cent were judged to be illegal.

The unit seized more than 30 times the number of dogs last year than in 2005 and the cost of kennelling the animals has risen to £2.75 million a year.

Now the Mayor's office wants to speed up court action to cut down on kennelling costs and is also urging the Government to extend the law to include dog attacks on private land, particularly to protect people who have to visit homes as part of their work.

Mr Malthouse said the use of dogs as weapons should be punished by tougher sentencing by the courts.

He said: "We've had over 4,000 signatures to our petition calling on the Government to act which proves that people do not feel that enough is being done to protect them.

"The Government needs to act urgently to protect Londoners and their pets from savage attacks by weapon dogs. Unless legislation is toughened up, these attacks will continue.

"Certain breeds are used and trained to be used as weapons and should carry the same penalties as other weapons, such as knives."

The demands come as the number of attacks and injuries caused by dangerous dogs is escalating. Officials believe the number of dogs seized is the tip of the iceberg as police have to concentrate on the most dangerous ones.

Battersea Dogs and Cats Home has also witnessed an increase in the numbers of dogs being admitted with injuries from fighting. Last year, it took in more than six thousand dogs.

Claire Lambert, whose two-year-old son Maurice was attacked in a Primrose Hill playground by a pitbull breed in 2008, said: "The attack on my son has left a permanent mark, not just on his leg, but also on us as a family. We want our beautiful London parks and open spaces to be a safe place for children."

http://www.bbc.co.uk/blogs/guysmith/2010/08/where_do_we_draw_the_line_on_d.html

Seven-year-old Jack Wellstead suffered horrific injuries when he was attacked by a pit bull terrier, and will have to wear a protective garment for two years to help his scars heal.

He was trapped in a hall with a neighbour's pit bull terrier for 10 minutes Stratford and sustained multiple bites. Part of his skull had to be glued back into place had skin grafts on his feet and thighs, 20 stitches in his wounds and some of his tissue has been removed to stop infection.

His mother Victoria Devlin, 44, said Jack was nearly back to normal after the attack in January but is often frightened when he sees a dog resembling the pit bull that attacked him.She said: "I think they should ban all dangerous dogs. Jack is not the first victim of them. I didn't even know the dog's owner had a pit bull, we were quite oblivious to it until it happened to him."

Jack is under the care of Mohammed Shibhu, a plastic and reconstructive surgeon at the Royal London Children's Hospital who operated on victims of the 2005 London Tube and bus suicide bombings.

The dog was destroyed and Ms Devlin said that she has forgiven its owners for the "freak accident". The dog is thought to have been legally owned.

Britain's top vet warned this year that there are more pit bulls in the capital than when the animals were banned under the 1991 Dangerous Dogs Act.

The number of dangerous dogs seized by the Met police has risen from 27 in 2004/5 to 1,152 last year. The force is so concerned that a status dog unit has been set up to tackle the problem.

NEW BEDFORD MA -PIT BULLS ARE DIFFERENT-IT'S NOT ABOUT DISCRIMINATION - POINT OF VIEW

YOUR VIEW:  It's not about discrimination: Pit Bulls are Different
by Debora Coelho

Debora Coelho is a councilor at large on the New Bedford City Council

Subject:  Legislation to control Vicious Dogs/Pit Bulls

Let's look at pit bulls the way gang-bangers and drug dealers and wise guys do. They use these dogs to intimidate and impress, to demonstrate how tough they are. They use them to protect themselves from rivals, decent neighbors and landlords and police.

Keeping a pit bull in a tenement is a way to discourage collectors, inspectors and census takers. These owners know the fear they instill. That's why they walk their unlicensed dogs anywhere they want. Who will challenge them? The average person isn't that brave. they know their dogs give them major power and control.

Each year, people and pets are savagely attacked and maimed. Occasionally, a human being is killed; frequently the victim is a small or gentle dog. In cities like ours, whole communities can be terrorized and intimidated by owners who keep their dogs for breeding purposes and intentionally leave them unsocialized and unneutered, turning them into angry, menacing weapons.

Don't just take my word for it. Open your eyes. I saw two young teenage girls walking a pit bull with two leashes. One pulling the dog to the right, while the other was pulling to the left. I quickly got my dog, Zoe, headed in the opposite direction, out of harm's way. That pit bull might have been harmless but he was barely under control, and out-of-control pit bulls have been involved time and time again in serious episodes of violence here and in the suburbs.

These are not ordinary animals. Insurance companies have statistical evidence to justify higher premiums on households with pit bulls and other aggressive breeds. Some landlords do not permit them on their property. But some tenants keep them without the landlord's permission or tie them in backyards without proper fencing. They can and do break loose and attack any pet or person unlucky enough to cross their path. It is not unusual in some city neighborhoods to see pit bulls left unattended on a sidewalk or running free in a park. That shouldn't happen in a safe and well-regulated city.

But what about responsible pit bull owners? Aren't we discriminating by being breed specific? First of all, if you're a responsible pit bull dog owner, you are not the problem. Your dog is properly licensed and trained. If it were to attack, you're properly insured to help pay medical or veterinarian bills or damages for pain and trauma.

This is about common sense, not discrimination. Dogs are not people. They are bred for specific purposes — to hunt, shepherd, guide, guard and even fight and attack and kill.

States and communities across America have passed sensible breed-specific legislation that enhances public safety. A year ago, I suggested that the City Council look into Boston's 2004 Pit Bull Ordinance to see if it might work here. I believe it would, because it deals with the same issues we are confronting. It requires annual registration, proper neutering and landlord permission. It requires the owner to be at least 18 and physically able to control a leashed pit bull. Landlords must post proper signage. Enclosures are required, and, in some cases, owners must purchase homeowner insurance covering the dog.

Obviously, a law is only as strong as its enforcement and we would have to be sure law breakers would be charged and penalized on conviction. The law would require more dog officers, if only on a temporary basis in the warmer months, but the expense would be justified in the interest of a city where everyone is safe to walk without fear of sudden attack from a dangerous dog

The attack happened on Friday night, May 27,    Its still not clear which dog  attacked the child.  Damien Jones, also known as Dread, is the owner of the dogs and trained the dogs and bragged to neighbors that his canines were "MONSTER DOGS."  According to neighbors, Jones would hang stuffed animals and a football from trees and fences so the dogs could tear them apart.  The investigation is still ongoing.

UPDATE:  There are conflicting reports on the breed of the dog and the date it happened.  The New York Daily News are saying the dog was a Pit Bull, or a Mastiff, or a Cane Corso and that the mauling happened Friday night the 27th.

AUSTIN TX - FREDDY HERNANDEZ GOT A CHRISTMAS SURPRISE HE DIDN'T ASK FOR - 2 PIT BULLS ATTACKING HIM !!!

UPDATE:  Friday, May 27, 2011 - In the first indictments of their kind in Travis co in at least a decade, a grand jury this week charged 2 people with failing to secure dogs who attacked victims without being provoked. Reginald Welton's charge arises out of a dog attack on Dec. 25, 2010, when Alfredo Hernandez was getting groceries out of his car at his house and was attacked by 2 Pit Bulls. The other charge is on Verna Cooper who is accused of  "recklessly" failing to restrain a Pit Bull that attacked Gracyn Aills on March 12, 2011.

Monday, Dec 27, 2010 - Austin Tx - 2 Pit Bulls attacked Freddy Hernandez in his front yard on Dec 25, Christmas Day,  as he was getting a sack of groceries from his car.  When he turned around they were right there behind him.  He tried to spook them to make them go away, but they came at him aggressively, taking him to the ground, biting him all over, EVEN BREAKING HIS ARM!!!

He was trying hard to fight even knowing he had a broken arm, then he remembered his knife and opened it up real fast and began stabbing them.  Austin Police told him that the knife helped save his life.  Animal Control arrived and began trying to capture the dogs and they still were acting aggressive.  Police had to fire several rounds from a shotgun before the dogs would go down.

Freddy had to spend some time in the hospital, but he says he's glad it happened to him and not to children in the area.

AUSTIN TX-PIT BULL ATTACKS FOR 3RD TIME-LATCHED ONTO 10 YR OLD GRACYN AILLS" LEG AND TOSSED ITS HEAD BACK AND FORTH TRYING TO TEAR HER LEG OFF- GRAND JURY INDICTS DOG OWNER

VERNA COOPER'S 2 PIT BULLS-ONE OF THEM GOT 3 BITES FREE

UPDATE:  http://www.kvue.com/news/Owners-indicted-in-dog-attack-that-mauled-two-people-122631624.html

May 25, 2011 - A Travis Co Grand Jury has indicted 2 individual dog owners on 3rd degree felonies after their dogs mauled 2 people.  One of those is VERNA COOPER who owned a Pit Bull which authorities say attacked 3 people on 3 different occasions.

The other is Reginald Welton whose charge arises out of a dog attack on Dec. 25, 2010.  In that attack Alfredo Hernandez was getting groceries out of his car at a house in East Austin when he was attacked by 2 Pit Bulls.  He pulled out a knife to defend himself  but the dogs bit him repeatedly including one bite that ---BROKE HIS ARM!!!!!!!!

http://www.statesman.com/news/local/two-austinites-indicted-after-dog-attacks-first-such-1503458.html

Animal Control Detectives with the City of Austin are hopeful that the indictment sends a message to owners of other aggressive dogs:  "These dog owners that own these animals that are dangerous or aggressive need to know that they're going to be held accountable for the actions of their dogs." She is facing 10 years in prison if convicted.

March 16, 2011 - Austin Tx - 10 yr old Gracyn Aills was attacked by a Pit Bull Sunday afternoon as she was going for a bike ride with her Dad, Peter Aills.  They had just pulled out of their driveway when he saw a blur (the neighbor's Pit Bull) tear out at Gracyn and latch onto her right leg and toss its head back and forth as if it was trying to tear her leg off. She began screaming for her Daddy!  She received more than 100 stitches at Dell Children's Hospital.  She is a cheerleader and gymnast and now she is in immense pain and cannot bend her leg and is worried she will never walk again.  Gracyn is the Dog's THIRD VICTIM!!!

In March 2009, Suzi Stern was bitten by the dog as she was jogging, and a person who came to her aid was also bitten.  At that time the owner, Verna Cooper, had 2 Pit Bulls and that year the dogs were deemed DANGEROUS BY THE CITY.  Cooper then sent the male Pit Bull to live with her daughter out of state.  She had to buy $100,000 insurance to keep the female.  ALSO REQUIRED BY LAW, COOPER HAD TO MAKE A SPECIAL ENCLOSURE IN HER BACKYARD TO KEEP THE DOG SECURE.  STILL, ON SUNDAY, INVESTIGATORS SAY THE DOG WAS ABLE TO GET OUT---

-------THROUGH AN UNLOCKED SIDE DOOR OF THE HOUSE--------.

Since Gracyn's wounds were so severe, the city seized the dog and euthanized it Wednesday morning.......THE VICTIMS FEEL IT WAS TOO LATE!!!!

"I was angry,  I was absolutely infuriated," Suzy Stern said.  "I don't think they are protecting the good citizens of Austin Tx and their best interests," Aills said.  A new state law--"Lillian's Law", named after a Thorndale woman killed by dogs while mowing her front lawn, allows officers to instantly seize dogs involved in attacks with serious injury.  That is how officers were able to remove Cooper's dog after Gracyn was mauled.  Lillian's Law allows officers to charge her with a third degree felony for the attack.  If charged, she could get up to 10 years in jail.

On Feb. 21, 2011, Robert Redwitz and his wife were walking their 2 pets.  "Out of the Clear Blue here come this Pit Bull and went right for our Dachshund.  It broke off from the Dachshund and then went after their Schnauzer.  The Pit Bull attacked 2 other dogs, including a Beagle and a Dalmation  that day on it's rampage before it was captured.  The Redwitz's beloved Dachshund died at a local clinic.  The Pit Bull had reportedly gotten away while Byrd was at work and someone was watching the dog for her.

A doctor testified that the Pit Bull's aggression has gotten worse during the 3 months it has been housed by the Charleston Animal Society, saying it barks, growls and charges its gate whenever another animal or human passes by. It's habits are so bad that staff veterinarian Brittany Tisa labeled Jager a public health concern.

Byrd's father told the judge:

*It had never shown violent behavior before
*The attacks were out of character
   *He's just a   "BIG BABY"

Paige Byrd opted to plead NO-CONTEST which the judge said for sentencing purposes amounts to a plea of guilty. She pleaded to:

KEEPING A VICIOUS ANIMAL AND ALLOWING AN ANIMAL AT-LARGE.  A THIRD CHARGE OF FAILING TO VACCINATE WAS DROPPED.  POSSIBLE JAIL TIME WAS SUSPENDED UPON HER PAYING MORE THAN $2,000 TO RESTITUTION, INCLUDING TO THE OWNERS OF THE OTHER INJURED DOGS.

Facebook
                         "LADY"

May 26, 2011 - C .C. Jones and his pet dog "Lady" were finishing up with their daily walk around Southwest Portland Thursday around 3 pm when a Pit Bull charged toward them biting Jones in the stomach and biting Lady on the leg, crushing it.  "The only thing I had time to do was to lift my dog up by the leash and harness and try to hold her out of harm's way.  That wasn't good enough, unfortunately," Jones said.  He took Lady to Dove Lewis Animal Hospital but he's on a fixed income and isn't sure how he'll pay for the medical bills, which could reach $3,700. But mainly Jones was concerned that the Pit Bull could harm other people in the area  including children and pets.  Animal Control was called to the scene and couldn't find the Pit Bull.

Tom McGeorge, Sarah's father, said the next thing he heard her say on the phone was, "Oh No, PLEASE DON'T TOUCH HER, PLEASE STOP!"  A PIT BULL had jumped a fence and come toward her.  She thought at first that the Pit Bull that had been tied to a tree in a front yard was reaching her with the chain still on it, so she pushed the baby stroller away from the area. and across the street thinking she could escape it.  But  the dog got free and came after her and bit her on the left side leaving gashes in her arm, buttocks, and shin, She will be making several trips back to the hospital to be treated for her wounds.

The owner's daughter came out after the attack to help her, and the owner, Shawna Varnum, who wasn't home during the attack, says she is very sorry.  Shasta County Animal regulation says the dog will be quarantined, then be put down.

TWO-THIRDS OF FATALITIES: A PIT BULL APOLOGIST CONFESSES!

http://www.opposingviews.com/i/two-thirds-of-fatalities-a-pit-bull-apologist-confesses

Two-Thirds of Fatalities: A Pit Bull Apologist Confesses!

Opinion by All American

(9 Hours Ago) in Society / Animal Rights

Ah yes, pit bulls, don't you just love them? I love them to the point that it doesn't matter the amount of damage they are doing, people need to change their ways to avoid the attack of a pit. I say that you need to lock yourselves in your homes, don't take out your trash, don't let the kids play in the backyard, don't walk down the street, especially with another dog.

And don't forget to block your windows and doors because pits will come through if you are provoking them by just being there. I just know that the grandmother who was sitting beside her grandchild and the pit came through the screen door and killed the child, had to provoked that pit bull, it was the grandmother's fault. After all pits are called the "nanny dog" and although that description has no basis for truth, you can repeat it anyway, no one will know the difference.
http://thetruthaboutpitbulls.blogspot.com/2010/08/nanny-dog-myth-revealed.html

Pits are never at fault, the victims always are. The world needs to learn how to accommodate pit bulls instead of wanting to put restrictions on pit bulls. They are great, loyal pets. Forget about how many attack their owners, after all anytime there is an attack, it is the irresponsible owner to blame, not the pits. Pits can do no wrong.

So what that it is said that pits are committing two-thirds of the fatalities. We, as pit owners and apologists, know that we can always say there is no such thing as a pit so those figures are not credible. Another thing is that pits are misidentified and the media has a conspiracy to "get the pits". It makes for good headlines to blame a pit bull.

Yes, I know that it is not the reporter that identifies the attacking pit but we can always say that it is an ignorant reporter who doesn't know a chihuahua from a pit.  http://thetruthaboutpitbulls.blogspot.com/2011/04/find-pit-bull.html   Besides chihuahuas bite more than pits, use that the next time. Doesn't matter that a bite from a chihuahua probably won't land you in the hospital or a casket, compare those apples to oranges, the public doesn't know the difference. Always talk bites, compare bite records to fatality records, it is confusing to the general public.

Also refer to "dogs will be dogs" just like when a guy rapes a girl, they always say "boys will be boys". The public understands this. Just because pits were bred specifically to fight and kill, unlike other dogs that were bred to be of service to mankind, doesn't mean they are different. Just because a pit doesn't have the same body language of other breeds doesn't mean it is different. Watch pits in a fight, they are wagging their tails because they are doing what they were bred to do and they like it.

Most dogs, granted, will bite and run away but not our game pits, they don't stop even if it means their death.  http://www.liveleak.com/view?i=477_1296278090  This is typical behavior of a pit and I am proud of it. I don't want them to change, I like their gameness. I laugh each time my pits rip into another dog, some useless wildlife, and especially when they "play" with livestock.

Another excuse you can make is that pits are always misidentified. We pit apologists invented a wonderful way to prove that they are misidentified. Who cares when the police, the vets, and animal control identify a pit, what do they know?  http://thetruthaboutpitbulls.blogspot.com/2011/04/find-pit-bull.html  And always refer to the media conspiracy to "get the pits".

Tell people that the media only reports if a pit bull is involved and the reporter will deliberately misidentify to make a more sensational headline. I often imagine all the journalists in the world getting together to form this conspiracy.

Remember to always bring up the National Canine Research Council. The public falls for those big names, deceptive or not. Yeah, I know this is not a national type of thing, yeah, I know that the main person is a self published author who basically has failed to get her books picked up by a reputable publishing house. The point is the public doesn't know that. There are more sources you can quote such as the AKC. Sure the AKC allows puppy mill cruelty but they don't want any cruelty on their big litter producing money maker, pit bulls and Staffies. By the way, pits have several names and staffie is just one of them. The ignorant public may not want a pit as a pet but they might take a Staffordshire Terrier, sounds better.

Even HSUS and the ASPCA stand behind the pits. Yes, they are donor driven and would lose donations if they came out against pits but does the public know that? It's easy to see how they have been bought with the dogmen's money because of the change over the years. Sure they bust dogmen, but it is the little ones, not the big guys. The big guys use their donations to support this because it is the easiest way to "get rid of their competition", just turn them in to HSUS. Keeps them all in business. Dr Michael Fox, Director of the Institute for the study of Animal Problems, Scientific Branch, Humane Society of the United States:

"I spent 20 years studying the behavior of dogs and it's not in their nature. Man, has created a monster, If you wish...These dogs were selectively bred to fight, they have greater propensity to fight than other animals."

"They can attack people, and because the attitudes of Pit Bulls it is more likely they will attack people. The worry is the power of the dogs jaw...to bite and not let go. It's quite sufficient to crush right through a child's arm or leg."

Randall Lockwood is often used as a source but he has changed his stance because of the pressure that us pit apologists have placed upon him. How dare he call our dogs canine psychopaths. http://pqasb.pqarchiver.com/boston/access/660427671.html?dids=660427671:660427671&FTM=ABS&FMTS=ABS:FT&type=currentdate=Jul+2C+1986&author=Dianne+Dumanoski%+19%2C+1986&author=Dianne+Dumanoski%2CGlobe+Staff&pub=Boston+Globe+(pre-1997+Fulltext)&desc=A+HOT+DOG+GETS+THE+COLD+SHOULDER%3B+PIT+BULL+BREED+BANISHED+IN+LYNN%3B+LOYALISTS+ATTACK+%22CANINE+RACISM%22&pqatl=google

Let's hope no one delves into the background of the AVMA. People think of vets in the same vein as doctors and don't question their motivations. The AVMA stands on the side of breeders because they are agribusiness friendly. Plus their vets make a lot of money taking care of the victims of pits so their stance insures their members of continuing to make money and send the AVMA dues. Who cares that they issued to their vets a brochure about pits being dangerous in their waiting rooms and how to handle them. It's an old report.  http://www.scribd.com/doc/13616704/Dos-and-Donts-Concerning-Vicious-Dogs%20by%20Dondald-H-Clifford%20Board  Board  members change and so do positions. We don't have to worry about them.

And the ASPCA, well they have put out literature on handling pits in shelters. Pits are the only breed that they dedicate literature to on their handling in the shelters.
 http://www.scribd.com/doc/14396422/ASPCA-Guide-to-Handling-P:it-Bulls-in-Shelter-Environments   Pits are soooo special!

We just can't seem to overcome the insurance industry's positions on pits. We have tried to force all insurance companies to insure pits, some do to an extent. So we just tell people to lie about the breed of dog they have. Too bad when there is an attack and the victim has no recourse to collect the hundreds of thousands of dollars for medical and the homeowner's insurance company says the homeowner misrepresented the dog so they won't pay. We don't care about the victims anyway, our pits are always innocent. Let the government take care of their injuries, let them sell their homes to give their kid a new face, it ain't our responsibility to support them.

And never mind the statistics that show regulation is reducing the euthanization of pits in shelters like Denver. Denver now has the lowest euthanization rate of pits in the entire country but don't tell anyone.  http://dogsbite.org/pop-pit-bull-death-chart.htm   Quote instead the stats from the hospital on bites. It works because the hospital serves outlying areas without regulation and all those bite cases are added in.

Makes it look like Denver has more bites since installing regulations. Aren't stats wonderful, you can always make them show what you want them to show. And if someone says anything about the Lancaster, California mayor who proclaims a 45% reduction in their crime rate since regulation and credits pit bull regulation for that reduction, just say that the mayor doesn't know what he's talking about.

Just remember defend pits no matter what against those Nazi, racist pit haters. Blame the victim, blame the "irresponsible" owner, blame cabin fever, whatever, just never blame the pit, they are always innocent. All they want to do is please us, they would die for us. Never mind what Randall Lockwood has to say that pits are six times more likely to attack/kill their owners.  http://www.scribd.com/doc/16267151/Are-Pit-Bulls-Different-An-Analysis-of-the-P:it-Bull-Terrier-Controversy-by-Randall-Lockwood-and-Kate-Rindy %20Lockwood Lockwood is now on our side and we use him as a reference. Strange, isn't it, how loyalties change. Pits are loyal and they deserve everything. Defend the Breed Because They Love Doing the Deed and that is why we love pits

MOBILE AL- 1992 - 4-YR-OLD-BOY MAULED BY DOG, HOSPITALIZED 5 DAYS - 200 STITCHES

Aug 23, 1992 - Mobile Al - The Gadsden Tines - Judge orders dog put to sleep (AP)  A dog that attacked 4-year-old boy was sentenced to death, but the animal's owner plans to appeal.

Mobile County circuit Judge Michael Zoghby ruled Friday that the dog named Caesar should be put to sleep for the July 30 mauling of Dennis Hare Jr. , who was hospitalized for five days and required more than 200 stitches.  "The court is concerned about this dog, but an animal is unpredicable.  And I don't doubt that he's a good dog, but he can be a bad dog, too," Zoghby said.

Thomas Swindle Jr. , the dog's owner, said the court ruling was unfair.  "It's totally wrong and I plan to appeal," Swindle said.  "Caesar is not a bad dog,....He was provoked by this unruly child.  And if they had given him back to me, I was going to move him outside the city of Mobile."

The attack occurred while Swindle and his family were living with the child's mother, Donna Hare.  Swindle has since moved his family to a motel in Saraland while Caesar's being kept at the Mobile animal shelter.  The City of Mobile present several witnesses who testified the dog had bitten other children.  Swindle's stepson, Matthew Ackerman, showed the judge a scar on his forehead that was caused by the dog.  Swindle said he was prepared to shoot the dog after the incident, "but after I talked to a police officer and found this stick with the dog's hair on it, I know he was provoked,"

Man attacked by pit bulls in Kirkland park, opens fire

May 22, 2011 - Tim Lewis was at a park throwing a tennis ball for his pet when the 3 Pit Bulls came at them....."ALL HELL BROKE LOOSE," he said.  The dogs began attacking his German Shepherd.  He fought for his dog and at one point he thought he had scared them off, but they came back.  The owner of the Pit Bulls, a Seattle man, JUSTIN LeValley,  also tried to pull the Pit Bulls  that were attacking in a pack off the German Shepherd.   Lewis, a legal gun owner who has a concealed weapon permit, shot one of the Pit Bulls and scared the other two.

There was a witness to the whole shabang !!!!!!!!!!!!! Charles McLennan was nearby and watched in horror as Pit Bulls attacked.  He also commented that if Lewis had not had a gun he probably would be dead.

NEW MEXICO-LETTER TO EDITOR AFTER VICIOUS DOGS KILL MARGARET SALCEDO AND OTHER ATTACKS HAPPEN: MANY ADULTS DO NOT BELIEVE THEY OWN A VICIOUS ANIMAL..WHY? THE NEXT TIME YOU OR YOUR CHILDEN ARE TAKING A WALK, I HOPE AND PRAY THAT SOMEONE'S PIT BULL DOESN'T TAKE YOU OUT!

City should have rules against vicious dogs-Alamogordo Daily News

Daily News Letter to the Editor in response to the recent MAULING DEATH OF A TRUTH OR CONSEQUENCES WOMAN BY 4 PIT BULL DOGS AND OTHER DOG ATTACKS.

Posted: 05/22/2011 12:00:00 AM MDT

Many adults do not believe they own a vicious animal. Why? They have raised it from a puppy and believe it wouldn't hurt a flea.

People think it's a status symbol to own a pit bull or a vicious dog. Part of being a pet owner is to train them, love them, spend time with them, feed them, water them, play with them and make sure they go regularly to the vet for care. You cannot get a dog, put it on a chain and leave it in the backyard barking all day and night for the neighbors to listen to.

So who do you get upset with the dogs who have no attention or the irresponsible pet owner?

Recently, a lady taking a walk suffered the attack of four pit bulls and paid the ultimate price with her life because the dogs were vicious and unattended by owners. A pit bull pet attacked a young boy causing him pain, suffering and a nightmare he will have for the rest of his life. This attack happened in the neighbor's home and no one can do anything. A postman in Alamogordo was attacked by two pit bulls. My eight-pound dog was attacked by a neighbor's vicious dog who came over the fence and into my yard.

I have lived in two towns where pit bulls are not allowed within the city limits. Do you know you can have an unlimited amount of animals in your home or yard? There is no ordinance restricting how many animals are allowed at each home. So what happens if you get a neighbor who has 10 dogs and leaves them in the backyard? Do people know they have to register their dog with Animal Control?

We need some guidelines in the city of Alamogordo. Remember that the next time you or your children are taking a walk, going to the park or playing outside. I hope and pray that someone's pit bull pet doesn't take you out.

Shame on the city of Alamogordo and the people who have not made rules and regulations for people who live in this city in regard to vicious animals.

TRUTH OR CONSEQUENCES NM - 48-YEAR-OLD WOMAN, MARGARET SALCEDO, KILLED BY 4 PIT BULLS WHILE TAKING A WALK ON EASTER SUNDAY- DESCRIBED AS A LOVING PERSON WITHOUT A MEAN BONE IN HER BODY !!!!!!!!

Truth or Consequences, NM - One of the dogs that killed Margaret Salcedo.

UPDATE:  In an interesting article from the Las Cruces Sun-News - April 26, 2011 - Clint Wellborn, Seventh Judicial district Attorney, said that John and Maria Hardiman could face criminal charges under a 2005 statute regarding "VICIOUS DOGS".  "We've never used it, but it makes it a third-degree felony if your dogs injure someone, with six years in prison if the attack is resulting in death.  The dog either has to be shown to have been found to be vicious by a court, previously, OR SHOWN THAT THE OWNER KNEW THE DOGS WERE VICIOUS."  While it's unknown if authorities had been called to the Hardiman home about their dogs, Wellborn said the office had dealt with John Hardiman before because he worked for "a very short time" as a Truth or Consequences police officer under a previous police chief.  This is the link to this story:

A Pit Bull got out of its fence three weeks ago and attacked Michelle Mitchell's 12-year-old son playing in Sonona  Jefferson's yard with other children.   Less than 2 weeks after this attack, the Pit Bull was returned to its owner. Then  the same dog  ran out of its yard again  and went straight for  Sonona Jefferson's  8-year-old son playing  kickball with other children in her backyard and bit him on  the leg.

"I'M NOT HERE TO POINT FINGERS OR TO BLAME.  I SIMPLY WANT MY CHILDREN AND ALL OTHER CHILDREN TO WALK IN THIS COMMUNITY SAFELY WITHOUT FEAR OF ANOTHER DOG ATTACK," SAID SONONA JEFFERSON.

The mothers took their concerns to the Williamston Police Department.  Williamston Police Captain Travis cowan says law enforcement has the ability to deem a dog dangerous after it attacks. It increases the level of security that the owner must use to prevent the animal from having access to the public."

BUT ANIMAL CONTROL NEVER DEEMED THE PIT BULL DANGEROUS BECAUSE THERE WERE NO BROKEN BONES OR DISFIGURING LACERATIONS.  COWAN SAYS INFORTUNATELY THIS IS AN EXAMPLE OF WHERE THE SYSTEM FAILED.  IT TOOK ANOTHER BITE AND ANOTHER POLICE REPORT TO FINALLY CITE THE OWNER FOR VIOLATING THE TOWN ANIMAL ORDINANCE.

THE RULES ARE CLEAR - A PIT BULL SHOULD BE KEPT IN A FENCED ENCLOSURE WITH A TOP AND A CONCRETE BASE.  THE PIT BULL SHOULD ALSO BE MUZZLED WHEN ON A LEASH.  COWAN SAYS WHILE HE CAN'T MONITOR WHAT DOG OWNERS DO 24-7, PEOPLE IN THE COMMUNITY CAN KEEP A CLOSER WATCH!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

"LET'S EDUCATE EACH OTHER.   LET'S NOT JUST STAND SILENT AND BE QUIET AN GO, 'OH, GOSH, I HOPE THIS DOESN'T HAPPEN'," SAYS SONONA JEFFERSON.

Police issued the owner a citation for violating the town's animal ordinance for not keeping the dog in a secure enclosure. The owner relinquished the dog to animal control and it will be put down in two weeks.

IN ANOTHER ARTICLE:  May 16, 2011 - Funkstown MD - Dog attack has agricultural community calling for tighter restrictions - In the wake of a weekend dog attack in which 12 sheep were killed and 8 injured, some are renewing calls for tighter rules against unrestrained dogs in Washington County.  Ronald Leggett, president of Washington Co Farm Bureau said better restrictions are needed for domestic dogs running around.....a leash law and higher fines maybe.  "I actually choked up looking at the pictures of the attacked sheep.  I've been an animal lover and a farmer all my life.  The Pit Bulls tore the faces  clear off the sheep.  The Jaw Bones were sticking out."  Mr. Leggett also said that he didn't think the Humane Society of Washington Co acted quickly enough in removing the surviving dog from the community.  "We as agriculture producers, felt that they should have went immediately and confiscated that dog, because once those animals have a taste for blood, they will return."

MOBILE AL - 1983 - AN 8-YEAR-OLD BOY WAS MAULED BY PIT BULL - HIS FAMILY TALKS ABOUT "ONE FREE BITE LAW"

"YOU DON'T GET ONE FREE ACCIDENT WHEN YOU HAVE A CAR ACCIDENT!!!!

July 17, 1987 - TIMES DAILY - (AP)  Mobile Al - Michael Coley was 8-years-old in 1983 when he was attacked by a PIT BULL while playing football with his friends. The wounds to his head and back have healed but the psychological scars are still with him, said  his parents, Sue and Jerry Coley.

Jerry Coley says his son would not go outside his house for a year, not even to the mailbox, and he had trouble in school. The other kids called him "SCARHEAD" so he wore a hood all the time. The family sued the dog's owner, but before the case went to trial, the court ruled the Coley's  were not entitled to any money other than what the owner's insurance policy would cover -- $1,000.  The Alabama Supreme Court affirmed the decision in a 5-4 opinion.  The trial court based its ruling on the state's current dog-bite law, which Mrs. Coley referred to as the "ONE FREE BITE LAW".  The law states the dog owner is co-liable for the acts of the dog unless the owner had knowledge of the vicious propensities of the dog.

The Coley's want to change the dog-bite law.  "We want it to be specific and name certain dogs such as Pit Bulls, German Shepherds, and Dobermans that have been known to be vicious.  Those dogs would have to be chained or kept behind an adequate fence. "There's got to be some protection for the VICTIM," Mrs. Coley said.

"YOU DON'T GET ONE FREE ACCIDENT WHEN YOU HAVE A CAR ACCIDENT!!!!

The Coleys have asked their state representative for help in amending Alabama's dog-bite law, and Mobile City Councilman, John Peavy, recently asked City Attorney, Rick Stout, to review the City's vicious dog ordinance to see what can legally be done to control specific breeds with violent natures, such as Pit Bulls.

TUSCALOOSA AL - 1987 - SPECIAL NEWS ARTICLE - PIT BULLS: ATTACK DOGS OR BELOVED PETS? INCLUDES 2 PIT BULL ATTACKS IN THE TUSCALOOSA AREA - THIS PROBLEM IS MORE THAN 30 YEARS OLD AND UNLESS IT TOUCHES YOU PERSONALLY, YOU DON'T KNOW ABOUT IT!

"I'VE NEVER KNOWN OF A PIT BULL THAT COULD BE CALLED OFF DURING A FIGHT. THEY LOSE THEMSELVES IN THE FIGHT."

Sunday July 12, 1987- The Tuscaloosa News - Life/Leisure  1-C
Pit  Bulls:  Attack Dogs or Beloved Pets?  by Mike Brantley-staff writer - The Tuscaloosa News ran two lengthy articles on the Pit Bull controversy.  Some of the issues covered is the increasing number of reported  Pit Bull attacks and the 35 plus cities that have either banned or placed severe restrictions on them. In 1987 Five people have been killed already by Pit Bulls.  This first article also covers the history of Pit Bulls being bred for fighting and interviews a breeder who tells his story that includes an incident where his oldest Pit Bull bit him when he went to spank his child ---"-but that's OK because that's what it was trained to do."  They also interview a veterinarian who speaks only good things about the dogs saying, " All the Pit Bulls I've been around are all nice with nice owners."

Then the writer interviews Steve Ledbetter, Shelter Manager for the Tuscaloosa County Humane Society, who disagrees with  the the Breeder and the Veterinarian in saying, "I think genetics plays a big part in it,  You have dogs that have been bred  200-300 years for fighting and their natural predisposition is to fight."  He believes Pit Bulls are more dangerous than other breeds and he goes on to tell of 2 attacks where people were seriously injured in the Tuscaloosa area:

On May 5, 1984, a 12-year-old girl in Northport was attacked by a 7-month-old PIT BULL that belonged to a neighbor.  The girl was playing with the dog in her backyard when it turned on her for no apparent reason.  She received injuries to her arms, legs, and back needing 52 stitches.

Also, on Sept 15, 1984, in an incident in Alberta City, a woman and her son were attacked in their yard by a neighbor's PIT BULL.  The woman saved her son by pulling the dog off him and he got in the house, but then the dog went after the mother biting her over and over and dragging her around the yard for nearly 10 minutes. She had bites all over and deep puncture wounds that could not be stitched up.

The writer goes on to tell about horrible  Pit Bull attacks that have happened nationally.  Ledbetter then states that dog fighting is a felony in 33 states including Alabama....still dog fighting goes on every weekend.

In the second article appearing in this Tuscaloosa New's Life/Leisure section about Pit Bulls titled ---PIT BULL ATTACKS SPUR TOUGH "VICIOUS DOG" LAWS ---this article taken from the Sarasota Herald Tribune writtened by Marc Zaloudek,  this writer begins by telling of a horrific Pit Bull attack on an elderly lady, Helen Dudgey in 1981 in Sarasota, who was severely mauled  by 2 Pit Bulls when she was riding her 3-wheeled bike in her neighborhood. She still suffers 6 years later from the attack, and she sued the owner of the dogs and settled out of court for a sum.

This writer gives information on Miami's attempt to control dog attacks by passing laws, as well as the state of Ohio, as well as the problems Insurance Companies have with these dogs. It ends with a quote from Marc Paulhus, a leading national authority on Pit Bulls and Southeast regional coordinator of the Humane Society of the United States,   who states this:

"I'VE NEVER KNOWN OF A PIT BULL THAT COULD BE CALLED OFF DURING A FIGHT.  THEY LOSE THEMSELVES IN THE FIGHT."

The animals can be so unpredictable that many humane societies won't place stray or unwanted Pit Bulls in new homes.

FRANKLIN CO AL - 2008 - A BOY WAS ATTACKED BY A NEIGHBOR'S PIT BULL - ARM SEVERELY MANGLED - "BEST ADVICE FOR FAMILIES WITH CHILDREN: KEEP THEM AWAY FROM PIT BULLS"

PARRISH SAID, "THE NATURE OF PIT BULLS IS WHAT HAS ANIMAL CONTROL OFFICIALS CONCERNED. PIT BULLS ARE VICIOUS. WHEN THEY BITE THEY INTEND TO HURT AND KILL THE VICTIM. THE BEST ADVICE FOR FAMILIES WITH CHILDREN IS ----

KEEP THEM AWAY FROM PIT BULLS !!!!!!

Mar 24, 2008 - A young boy had his arm severely injured Thursday afternoon, March 20, when a neighbor's PIT BULL  attacked him.  Grady Parrish, Franklin Co. Animal Control Officer, said the incident happened when two boys were playing pool behind the home and a neighbor's dog broke loose.  It was an unprovoked  attack.  Parish said Pit Bulls have become a problem throughout the county in the last year.  Incidences like this have become commonplace:

....."I CAN THINK OF 6 INCIDENCES...AND THERE IS NOTHING WE CAN DO,".....SAID PARRISH. "IF A DOG BITES SOMEONE EVERYDAY, WE WILL JUST HAVE TO QUARANTINE IT, AND THEN GIVE IT BACK TO THE OWNER."

Surrounding counties are a little more strict with dangerous dogs.  Kenny Price, Colbert Co. Animal Control Supervisor, said that when a vicious dog has bitten, If he deems that dog is not confined properly, he will confiscate that animal.

The City of Florence  has a specific vicious dog ordinance.  If animal control officers find an overly aggressive dog, they require the owner to meet specific guidelines in fencing the dog.  If the owners do not obey, they can be ordered to remove the dog from the city, and be forced to go to court.

Parrish said that Franklin County  needs some type of vicious dog law enacted, but that doesn't look likely any time soon.  The County Commission can't enforce a law like that Parrish said.  It has to be approved by the legislature.

PARRISH SAID, "THE NATURE OF PIT BULLS IS WHAT HAS ANIMAL CONTROL OFFICIALS CONCERNED.  PIT BULLS ARE VICIOUS.  WHEN THEY BITE THEY INTEND TO HURT AND KILL THE VICTIM.  THE BEST ADVICE FOR FAMILIES WITH CHILDREN IS --------

SACRAMENTO CA -1987 - GRANDPARENT'S PIT BULL ATTACKS TWO GRANDCHILDREN ON SEPARATE OCCASIONS - LITTLE GIRLS WIN LARGE SETTLEMENT AGAINST THEIR INSURANCE COMPANY

August 6, 1987 - Sacramento CA - Two little girls who were attacked by a Pit Bulldog while visiting their grandparents have won a $399,500 settlement from the grandparent's insurance company.  The case was settled 5 days before it was to come to trial in Solano Co.  Both girls were bitten by a Pit Bull named Rich while visiting the home of their grandparents, Zern and Maria McCord.

The first incident occurred in March 1986, when Lori Vosefski, age 3, put her arm around her grandmother and the dog reacted by biting the child's ear.  In June 1986, the second incident occurred when 20 months old, Vanessa Abreu was visiting the McCords and the same Pit bull lunged at her and bit her in the mouth area causing a wound that required 60 stitches to close.

Timothy Walsh, attorney for the plaintiffs said the McCord's 17-year-old son was also named as a defendant after a Private Investigator found evidence that he had trained the dog to attack humans.   Walsh said:

THE SETTLEMENT SHOULD SERVE AS A WARNING TO OTHER PIT BULL OWNERS TO TAKE OUT INSURANCE - "PIT BULLS ARE VERY EXPENSIVE DOGS TO HAVE."
