BRANDON MS - THE CITY HAS AN EXCELLENT PIT BULL ORDINANCE - ONE MAN HAD HIS VARIANCE REVOKED AFTER HE VIOLATED THE CONDITIONS OF THE ORDINANCE

The Brandon Board of Aldermen recently voted to revoke a  PIT BULL ORDINANCE  after the owner of 3 Pit Bulls violated conditions of the ordinance.  The variance granted to Andrew Lloyd of Sagewood Drive in August.....

ALLOWED HIM TO KEEP THREE PIT BULLS ON HIS PREMISES.  TWO MONTHS LATER, POLICE SAW THE DOGS RUNNING LOOSE AND ONE JUMPED ON A NEIGHBOR AND SCRATCHED HER LEG WHILE SHE WAS HOLDING HER INFANT.  THE DOGS ALSO REPORTEDLY ATTEMPTED TO ATTACK OTHER DOGS THROUGH FENCES.

Police captured the dogs and while searching the premises found a fourth  PIT BULL  inside the house, along with  15 Pit Bull puppies  and 2 BREEDERS CERTIFICATES.  The puppies were sick and euthanized and the others were transported to the Rankin County Animal Shelter.

Sec. 14-60

Keeping of Pit Bull Breed Dogs Prohibited and Variance Process for the keeping of Pit Bull Breed Dogs.

A.  No person shall keep any pit bull breed dog (pure-bred or any amount), within the City of Brandon.  For Purposes of this Ordinance, a pit bull breed dog shall include any American Pit Bull Terrier, American Staffordshire Terrier, Staffordshire Bull Terrier, or any dog displaying the majority of physical traits of any one or more of the above breeds, or any dog exhibiting these distinguishing characteristics which substantially conform to the standards established by the American Kennel Club or United Kennel Club for any of the above breeds.

B.  Variance Procedure for keeping Pit Bull Breed Dogs (Pure-bred or any amount) identified in Section 14-60 A.

  1. (a)  A variance from the prohibition in Section 14-60 (A) may be sought by submitting a written request to the city clerk on the form approved by the city for this purpose.  When seeking a variance, in addition to the written request, the applicant must have in place an approved pen/enclosure  for each dog approved by the Chief of Police or his designee, and which pen/enclosure shall secure an area of not less than 100 sq. ft. and shall have (i) a concrete floor covering the entire area (ii) a chain link fence, a minimum 6 ft. in height, around the entire pen/enclosure, and (iii) a roof and /or cover over the entire pen/enclosure capable of preventing the dog from escaping.  The approved pen/enclosure shall be located within a fenced back yard. The applicant must also submit, at the time of the filing of the variance request, (1)proof of an effective homeowner's  liability policy  (including the Declaration Pages of such insurance policy) insuring the property where the dog (s) are kept and insuring the dog (s)  which are the subject of the variance, with minimum liability coverage of $100,000 and (2) an original letter from the homeowners' insurance company addressed to the City of Brandon indicating  (i)  knowledge of the insurance company of the presence of the dog (s) at the insured address, by name or other identification method, and that the insurance is  in force and effect, (ii)  that the insurance provides liability coverage for injuries to persons or property caused by the dog(s), and (iii) that in the event the insurance is canceled, non-renewed  or otherwise terminated for any reason that the City of Brandon will be provided notice thereof in writing before the cancellation, non-renewal or termination thereof.

  (b) Owners in possession of any prohibited dog as of the time of the adoption of this Ordinance, shall be permitted 60 days from adoption to apply for and obtain a variance to keep such prohibited dog(s).


2.  Upon receipt of the variance request, the City of Brandon shall consider the same and may approve the same, if all the conditions precedent have been accomplished by the applicant, and it is determined that the granting of the same will not otherwise create a nuisance or negatively affect the quiet use and enjoyment of others in the community.

 HALLELUYAH !!!!!  AMEN !!!!!  THERE ARE PEOPLE WITH COMMON SENSE RUNNING SOME CITIES AND THEY DO NOT LET THE PIT NUTTERS TAKE OVER AND MAKE THE RULES ROBBING ORDINARY CITIZENS OF THE VALUE OF THEIR PROPERTY AND THE ENJOYMENT OF THEIR PROPERTY......AN ACTIVE CHIEF OF POLICE MANAGING THIS ORDINANCE AND LOOKING OUT  PROACTIVELY  TO INSURE THE SAFETY AND WELFARE OF CITIZENS OF THEIR COMMUNITY !!!!!
